Victim Rights Guide

Victim Rights Guide: Under Oregon Law, victims of crime have victim rights. Victim Assistance can assist with these rights. It is a victim’s responsibility to inform Victim Assistance which rights they would like to assert. Some rights are automatic and some must be requested. Victims can also choose to assert rights on their own.

Pre-Trial Rights:

  • To be present at any open court hearing.
  • If requested, to be informed in advance of any critical stage court hearings.
  • To attend and be heard at pre-trial release hearings.
  • If requested, to be notified in advance of pre-trial release hearings.
  • To refuse to be interviewed by a defense attorney or investigator for the defendant or youth offender.
  • To get a copy of a transcript or recording of open court proceedings, if one is made. Fees may apply.
  • If requested, in a DUII automobile case that information shared with the defendant is also shared with you.

Plea and Sentencing Rights:

  • If requested, in a violent felony case to be consulted about plea negotiations or final plea offers.
  • At sentencing, to attend and be heard in person or in writing.

After Sentencing Rights: (See Offender Location tab)

  • If requested, to be notified in advance of probation revocation hearings.
  • Be heard at a hearing to set aside a conviction.
  • If requested, to be notified 30 days before the convicted person is released from prison.
  • If requested, and you provide the Oregon Youth Authority (OYA) with your contact information, to be notified of a juvenile offender release from an OYA Youth Correctional Facility.
  • If requested, and you complete the Board of Post Prison Supervision Request for Notification, to be notified of, appear at and be heard at the Board of Post Prison Supervision hearings.
